Agreement
Your receipt of an electronic or other form of order confirmation does
not signify our acceptance of your order, nor does it constitute
confirmation of our offer to sell. A-Tach Mounts reserves the right at
any time after receipt of your order to accept or decline your order for
any reason or to supply less than the quantity you ordered of any item. Your
order is an offer to purchase the products you specified ("Products")
according to the terms and conditions below. These terms will become a
contract ("Agreement") when your order is accepted by A-Tach Mounts
either by sending to you a “Processed” order confirmation that
specifically references your order or by shipping the Products to you.
By completing your order, you represent you have the legal authority to
enter into this Agreement on behalf of yourself or any party you
represent.

These conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether this store signs them or not. A-Tach Mounts reserves the right to make changes to this site and these conditions at any time.

We keep your personal information private and secure. When you make a
purchase from A-Tach Mounts, you provide your name, email address,
credit card information, address, phone number and a password. We use
this information to process your order(s), to keep you updated on your
purchases and to personalize your shopping experience.
Our secure servers protect your information using advanced encryption techniques and firewall technology.
To
keep you informed about our latest offers, we may notify you of current
promotions, specials and new additions to this store. You may
unsubscribe from our newsletters by following the unsubscribe
instructions in any email you receive from us.
We
use "cookies" to keep track of your current shopping session to
personalize your experience and so that you may retrieve your shopping
cart at any time.
Taxes
Our store will automatically charge and withhold the applicable sales
tax for orders to be delivered to addresses within the same
state/province where A-Tach Mounts holds a presence. For orders shipped
to other areas, you (the shopper) are solely responsible for any sales
taxes and/or other taxes that may apply.
Order Processing
Orders
typically get processed the same day or next business day. Due to the
carrier pick up time, an order will most often be picked up the
following day it is processed.

Shipping
We ship all
domestic orders with USPS first class service. Packages typically arrive
at most all locations in the mainland 48 States in 3-5 business days.
3-5 days cannot be guaranteed due to the many uncontrollable conditions
that can affect delivery services.
Shipping Issues
When
packages are stalled, misdirected, lost, or potentially stolen during
the delivery process, the matter will be resolved by either:
(a) locating and delivery of the original package, or
(b) refund of the purchase amount.
In all cases, Customer cooperation, as outline below, is required to pursue a resolution.
When
tracking shows the package as NOT delivered, and the package is
stalled, misdirected, or still in transit after 10 days, A-Tach
Mounts will launch a missing package claim with the
carrier in an attempt to locate the package. A USPS missing package
claim decision typically takes about 5-10 business days to give
notification. After the
notification comes back, if the package has not been delivered or
located, we will resolve the matter by issuing a refund or sending
another order out. A-Tach will not send a second package or order out
until it is recorded as lost.
When
tracking shows the package as "Delivered" but the package is missing,
the Customer must file a Police Report and file a Stolen Mail Report
with the Postal Service, and forward written copies of these reports to
A-Tach Mounts. A-Tach Mounts will then begin working toward a resolution upon receipt of
these reports. You may be required to provide additional documentation.
Risk of Loss
Risk
of loss is transferred to you when A-Tach Mounts delivers your packaged
order to the delivery service. When the delivery company makes the last
scan as “Delivered”, you are responsible for locating the order/package
if it is not at the delivery address.
Return Policy
Return Policy
Before
any product may be returned, A-Tach must give prior approval. An RMA# (Return
Merchandise Authorization Number) needs to be given to return a product. All
returns must be within (30) days of the invoice date and shipped back within 15
days. Any returned product must be undamaged and in like new condition.
Returned product must be scratch free with no additional holes or screw marks
on the product. Once the product is damaged or blemished, the product is
considered used and can no longer be refunded.
If fraud is under consideration, A-Tach determines if a product can be returned and under what condition. A-Tach reserves the right to withhold any refund if the product is believed to be damaged when returned. A return should include a copy of the original order or invoice. All parts and components that were shipped with the original product must be included with the returned product. The shipping and packaging costs will be the buyer’s responsibility. Shipping costs are not refundable. Returns are subject to a restocking fee.
Limited Warranty
A-Tach
warrants the product to be free of all defects in materials and workmanship for
a period of six (6) months from the date of purchase. This warranty extends to
the original buyer. In the event of a defect, buyer shall notify A-Tach within
5 days of receipt of the product by sending photos to [email protected]. Damaged products, including
cosmetic damage, caused by anything outside of shipping damage are not covered
by this warranty.
In
the event a product is deemed by A-Tach to be damaged or defective and the
buyer makes a claim, A-Tach has the option to repair or replace the item. All
repairs and service must be done by A-Tach. The Product must be delivered to
A-Tach during the warranty time along with proof of purchase price and date.
Labor costs and parts to repair will be A-Tach Mounts responsibility. The
shipping and packaging costs will be the buyer’s responsibility.
This
limited warranty does not extend to any Product which has been altered, modified,
reverse engineered, used in connection with a product not made by A-Tach or
damaged as a result of accident, misuse, abuse or as a result of unauthorized
service. A-Tach
Mounts will not be responsible for any damage to the vehicle or product due to
the installation and/or use of the product. A-Tach is not responsible for
damage to the vehicle mount caused by extreme heat conditions.
Any of the above exclusion may not apply in states that do not allow the exclusion or limitation. This warranty gives the Customer specific legal rights. The Customer also may have other rights which vary from state to state.

Restocking Fees
Shipping
is a service that is provided by an outside source. Once a package is scanned by
the shipping carrier as delivered or is returned to the sender by the shipping carrier,
a restocking fee will be applied to any product returns that are sent back to
A-Tach for any reason outside of an incorrectly sent item.
Limitation of Liability
A-Tach
Mount’s total liability, even if for breach of contract, warranty, late
delivery and/or no delivery, negligence, strict liability in tort or
otherwise, is limited to the price of the specific product or products
sold with respect to which losses or damages are claimed. In no event
will A-Tach Mounts be liable to you or any third party for any
incidental or consequential damages, including, without limitation,
indirect, special, punitive, or exemplary damages, including attorney
fees arising out to the use of or the inability to use the products, or
for any claim be any other party, even it A-Tach Mounts has been advised
of the possibility of such damages.
Governing Law
This agreement shall be governed by the laws of the State of Washington, without regard for its conflict of law provisions.
A-Tach
Mounts may alter or discontinue Products at any time. A-Tach Mounts
will ship the Product ordered by the Customer. Some differences between
what is described and what is shipped are possible.
Multiple Product Orders
For multiple product orders, we will make every attempt to ship all
items contained in that order at the same time. Products that are
unavailable at the time of shipping will be shipped as they become
available, unless you inform us otherwise. You will only be charged for
products contained in a given shipment, plus any applicable shipping
charges. You will only be charged for shipping at the rate quoted to you
on your purchase receipt. The entirety of this shipping charge will be
applied to the first product(s) shipped on a multiple shipment order.
Out-of-Stock Products
We will ship your product as it becomes available. Usually, products
ship by the next business day. However, there may be times when the
product you have ordered is out-of-stock, which will delay fulfilling
your order. We will keep you informed of any products that you have
ordered that are out-of-stock and unavailable for immediate shipment.
You may cancel your order at any time prior to shipping.
Severability
If
any provision of this Agreement is held to be invalid or unenforceable
by any law, rule, order or regulation of any government or by the final
determination of any state or federal court, such invalidity or
unenforceability of any one or more of the provisions hereof shall not
affect the validity or enforce ability of the other provisions hereof.
